Most seats on a condo assocation's board of directors are filled by volunteers, but that volunteer opportunity can turn into a living nightmare without the proper coverage.
Adequate and affordable coverage is readily available; however, most boards or associations do not have adequate coverage. Instead they depend on their package policy to include Directors and Officers. This important coverage should not be an add-on, buy-back, or endorsed coverage; it requires careful thought. While the direct and nationally known carriers provide full D & O coverage, their coverage is often inadequate.
How do you know what is adequate coverage? If you cannot answer yes to the following questions, your D & O is probably not sufficient.
- Does the definition of "insured" extend beyond the actual directors and officers?
- Does the definition of "insured" protect past, present and future directors?
- Does the definition of "insured" include committee members or volunteers?
- Does the definition of "insured" include employees?
- Does the policy cover spouses of directors and officers?
- Does the policy cover wrongful termination or other employer liability claims?
- Does the policy cover discrimination?
- Does the policy defend where there is a claim for failure to maintain or obtain adequate insurance?
- Does the policy provide coverage for the property manager?
- Does the policy cover libel and slander?
While the exposure is complex, the solution is simple: Call Interstate for your Directors and Officers needs. We provide an adequate and affordable home for this coverage with A+ or better rated carriers.
